1. Agreement to These Terms

By purchasing, accessing, or using Digital Growth System or any related services, you agree to these Terms & Conditions.

If you are purchasing or using the services on behalf of a business or organization, you represent that you have authority to accept these Terms on its behalf.

If you do not agree to these Terms, you should not purchase or use the services.

2. Digital Growth System Services

Digital Growth System provides digital tools and services designed for local service businesses.

Depending on your plan and configuration, services may include:

  • Professional business website
  • Website hosting
  • Business phone functionality
  • Business SMS functionality
  • Missed call text back
  • Lead and customer management tools
  • All-in-one communication inbox
  • Lead capture forms
  • Review request systems
  • Customer re-engagement tools
  • Google Business Profile assistance
  • Local SEO foundations
  • Initial system configuration
  • Ongoing technical support

Specific features may depend on third-party software, telecommunications providers, integrations, eligibility, verification requirements, and the information or access you provide to us.

Initial Setup Fee $0

Digital Growth System Starter is currently offered as a recurring monthly service at the price displayed at the time of purchase.

Unless otherwise stated during checkout or agreed to separately in writing, your subscription continues on a month-to-month basis until cancelled.

4. Billing and Recurring Payments

By purchasing a recurring Digital Growth System subscription, you authorize us and our payment provider to charge the payment method associated with your account for recurring subscription fees and applicable taxes or charges disclosed to you.

Subscription charges are generally billed in advance for the applicable service period.

You are responsible for maintaining accurate billing information and a valid payment method where recurring billing is used.

If a payment cannot be processed, access to some or all services may be suspended until the outstanding balance is resolved.

5. Cancellation

You may request cancellation of your Digital Growth System subscription by contacting us using the contact information provided below.

Unless otherwise agreed in writing, cancellation stops future subscription renewals after the applicable cancellation becomes effective.

Cancelling your subscription may result in the loss of access to services, software, hosting, phone functionality, automations, integrations, and other components provided as part of your subscription.

Before cancelling

If there is information you need to retain, contact us before cancellation so we can explain what information may be available for export or transfer.

6. Refunds

Requests for refunds will be reviewed based on the circumstances of the purchase, services already provided, and any refund terms displayed or agreed to at the time of purchase.

Unless required by applicable law or otherwise agreed by us, cancellation does not automatically create a right to a refund for services already provided or a billing period that has already begun.

7. Onboarding and Client Responsibilities

Successful setup of Digital Growth System depends on your timely cooperation.

You may be asked to provide items such as:

  • Accurate business information
  • Business registration information
  • Website and domain information
  • Google Business Profile access
  • Business photos and branding assets
  • Services and service-area information
  • Phone and SMS compliance information
  • Authorized business representative information
  • Customer lists you are legally permitted to use
  • Other information reasonably required to configure your system

Delays in providing requested information, documents, approvals, or access may delay setup, verification, launch, or certain features.

8. Accuracy of Information

You are responsible for ensuring that information you provide to Digital Growth System is accurate, complete, and authorized for use.

This includes business registration information, addresses, contact details, services, pricing, offers, photos, customer information, claims, licenses, and other content associated with your business.

We are not responsible for problems resulting from inaccurate, incomplete, misleading, or unauthorized information supplied by you or someone acting on your behalf.

9. Client Content and Materials

You retain your rights to original logos, photographs, text, customer information, and other materials that you provide to us.

By providing materials to Digital Growth System, you grant us permission to use, reproduce, format, modify, upload, and process those materials as reasonably necessary to provide your services.

You represent that you own the materials you provide or otherwise have the necessary permission to use and provide them to us.

10. Websites, Hosting, and System Access

Websites, hosting, automations, workflows, software configurations, communication tools, and other system components may be provided as part of an active Digital Growth System subscription.

Your original business content and materials remain yours. However, access to hosted websites, software, templates, system configurations, automations, and managed infrastructure may depend on maintaining an active subscription.

If your service ends, contact us before termination if you need to discuss available options for content, domains, or information that may be eligible for transfer or export.

11. Domains and Third-Party Accounts

You remain responsible for third-party accounts and assets that you own, including domain registrations and business profiles, unless otherwise expressly agreed.

When you grant Digital Growth System access to an account, you authorize us to make changes reasonably necessary to provide the requested services.

We recommend granting delegated or manager access whenever supported rather than sharing account passwords.

12. Phone Numbers, SMS, and Telecommunications

Phone and SMS services may be subject to telecommunications provider rules, carrier requirements, registration processes, identity or business verification, messaging policies, and applicable laws.

Approval, availability, delivery, throughput, registration, or continued use of phone and messaging services cannot be guaranteed.

Certain services may require additional business documentation or verification before they can be activated.

13. Messaging and Marketing Compliance

You are responsible for ensuring that your business communications, customer lists, marketing campaigns, and use of phone, SMS, and email comply with laws and regulations applicable to your business and recipients.

You must only contact individuals where you have the appropriate permission or other lawful basis to do so.

You agree not to use Digital Growth System to send:

  • Spam or unauthorized bulk communications
  • Deceptive or misleading messages
  • Messages to contacts you are not permitted to contact
  • Illegal, abusive, fraudulent, or harmful content
  • Content prohibited by applicable carriers or service providers

We may suspend messaging functionality where necessary to address suspected abuse, compliance concerns, provider requirements, or legal obligations.

14. Customer Lists and Re-Engagement

If you provide a past customer or contact list for import, re-engagement, review requests, or other communications, you represent that your business is permitted to possess, provide, and use that information for the intended purpose.

Digital Growth System does not independently verify the consent or legal status of every contact supplied by a client.

15. Google Business Profile and Third-Party Platforms

Certain Digital Growth System services may involve third-party platforms such as Google Business Profile, telecommunications providers, payment providers, email providers, domain registrars, social media platforms, and other software services.

These services are controlled by third parties and may change their features, pricing, policies, verification requirements, APIs, or availability at any time.

Digital Growth System is not responsible for third-party account suspensions, policy decisions, outages, algorithm changes, rejected verifications, or other actions outside our reasonable control.

16. Reviews and Reputation Management

Review request tools are intended to help your business ask customers for feedback and reviews.

We do not guarantee that customers will leave reviews, that reviews will be positive, or that any third-party platform will publish or retain a submitted review.

Your use of review functionality must comply with the rules of the applicable review platform and applicable laws.

17. No Guarantee of Business Results

Digital Growth System provides technology, systems, setup, and related services designed to help businesses manage opportunities and customer communications.

We do not guarantee a specific number of leads, customers, appointments, reviews, sales, revenue, search rankings, or other business results.

Results can depend on many factors outside our control, including your market, location, competition, pricing, reputation, service quality, response times, advertising, customer demand, and how your business uses the system.

18. Acceptable Use

You may not use Digital Growth System or related services to engage in unlawful, fraudulent, abusive, deceptive, harmful, or unauthorized activity.

You may not attempt to:

  • Gain unauthorized access to systems or accounts
  • Interfere with the operation or security of our services
  • Distribute malware or malicious code
  • Use our services to impersonate another person or business
  • Use our services in violation of third-party rights
  • Resell or misuse managed services without authorization

19. Intellectual Property

Digital Growth System retains its rights in its brand, processes, documentation, reusable templates, system designs, workflows, automations, software configurations, and other materials developed or owned by Digital Growth System, except for client-owned materials or where otherwise agreed in writing.

Purchasing a subscription does not transfer ownership of Digital Growth System's underlying intellectual property to you.

20. Service Availability and Changes

We work to maintain reliable services, but we do not guarantee uninterrupted or error-free availability.

Maintenance, technical issues, internet outages, carrier problems, third-party outages, security events, or circumstances outside our reasonable control may temporarily affect service availability.

We may modify, replace, or discontinue features when reasonably necessary to operate, maintain, improve, or comply with requirements affecting the services.

21. Suspension or Termination

We may suspend or terminate access to some or all services when reasonably necessary due to nonpayment, misuse, suspected fraud, security risks, unlawful activity, serious violations of these Terms, or requirements imposed by service providers or law.

Where reasonably practical, we may provide notice and an opportunity to resolve the issue before termination.

22. Disclaimer of Warranties

To the extent permitted by applicable law, Digital Growth System and its services are provided on an “as available” basis.

We do not make warranties regarding specific business outcomes, uninterrupted availability, third-party platform performance, or results that depend on circumstances outside our reasonable control.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Digital Growth System will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of or inability to use the services.

This may include lost profits, lost opportunities, loss of data, business interruption, or losses resulting from third-party platforms or services outside our reasonable control.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

24. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or expenses arising from your unlawful use of the services, content or information you provide without authorization, your violation of applicable messaging or marketing laws, or your material breach of these Terms.
